Privacy Policy

  1. Introduction

The EU General Data Protection Regulation (GDPR) replaces the Data Protection Directive 95/46/EC and was designed to harmonise data privacy laws across Europe, to protect and empower all EU citizens’ data privacy and to reshape the way organisations across the region approach data privacy. EU GDPR is the most important change in data privacy regulation in 20 years.

General Data Protection Regulation (GDPR) came into force on 25th May 2018 and replaced our existing Data protection law in the UK. It affects any organisation which holds and processes data relating to European citizens

Aid to Church in Need (ACN UK) is committed to conducting its business in accordance with all applicable Data Protection laws and regulations and in line with the highest standards of ethical conduct. This policy sets forth the expected conduct of ACN UK’s Employees and Third Parties in relation to the collection, use, retention, transfer, disclosure and destruction of any Personal Data belonging to ACN UK’s Contact (i.e. the Data Subject/benefactor).

Personal Data is any information (including opinions and intentions) which relates to an

Identified or Identifiable Natural Person and is subject to certain legal safeguards and other regulations, which impose restrictions on how organisations may process Personal Data. An organisation that handles Personal Data and makes decisions about its use is known as a Data Controller. ACN UK, as a Data Controller, is responsible for ensuring compliance with the Data Protection requirements outlined in this policy

ACN UK’s leadership is fully committed to ensuring continued and effective implementation of this policy and expects all ACN UK Employees and Third Parties to share in this commitment. Any breach of this policy will be taken seriously and may result in disciplinary action or business sanction. This policy has been approved by ACN UK’s Data Protection Officer.

  1. Definitions

Regulation: A regulation is a binding legislative act. It must be applied in its entirety across the EU

Directive: A directive is a legislative act that sets out a goal that all EU countries must achieve. However, it is up to the individual countries to decide how. It is important to note that the GDPR is a regulation, in contrast to the .previous legislation, which is a directive.

Employee: an individual who works part-time or full-time for ACN UK under a

contract of employment, whether oral or written, express or implied, and has recognised

rights and duties (Including temporary employees and independent contractors).

Third Party: An external organisation with which ACN UK’s conducts business and

is also authorised to, under the direct authority of ACN UK, Process the Personal Data of ACN UK Contacts.

Personal Data: Any information (including opinions and intentions) which relates to an

identified or Identifiable Natural Person.

Contact: Any past, current or prospective ACN UK customer.

Data Controller: A natural or legal person, Public Authority, Agency or other body which, alone or jointly with others, determines the purposes and means of the Processing of Personal Data.

Data Subject: The identified or Identifiable Natural Person to which the data refers e.g. . ACN UK’s benefactors

Process, Processed, Processing: Any operation or set of operations performed on

Personal Data or on sets of Personal Data, whether or not by automated means. Operations performed may include collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Data Protection: The process of safeguarding Personal Data from unauthorised or unlawful disclosure, access, alteration, Processing, transfer or destruction.

Data Protection Authority: An independent Public Authority responsible for monitoring the application of the relevant Data Protection regulation set forth in national law.

Data Processors: A natural or legal person, Public Authority, Agency or other body which Processes Personal Data on behalf of a Data Controller.

Consent: Any freely given, specific, informed and unambiguous indication of the Data

Subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the Processing of Personal Data relating to him or her.

Special Categories of Data: Personal Data pertaining to or revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership; data concerning health or sex life and sexual orientation; genetic data or biometric data.

Third Country: Any country not recognised as having an adequate level of legal protection for the rights and freedoms of Data Subjects in relation to the Processing of Personal Data.

Profiling: Any form of automated processing of Personal Data where Personal Data is used to evaluate specific or general characteristics relating to an Identifiable Natural Person. In particular to analyse or predict certain aspects concerning that natural person’s performance at work, economic situations, health, personal preferences, interests, reliability, behaviour, location or movement.

Binding Corporate Rules: The Personal Data protection policies used for the transfer

of Personal Data to one or more Third Countries within a group of undertakings, or group of enterprises engaged in a joint economic activity.

Personal Data Breach: A breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Personal Data transmitted, stored or otherwise Processed.

Encryption: The process of converting information or data into code, to prevent unauthorised access.

  1. Who we are?

Aid to the Church in Need is an international Catholic charity which supports the Church around the world – particularly where it experiences suffering and persecution. Our projects helping Catholic, Orthodox and other Christian communities and sometimes minority faiths is ‘niche’ and of limited interest to the wider general public. Catholic projects worldwide tend not to attract government funding so without support from the Catholic and Christian community in the UK and around the world, our project partners would not receive the prayer, pastoral and practical help and advocacy they require. A strong example of this is ACN’s support for Christians in Iraq who, for over six years have relied on ACN and other faith-based organisations to survive genocide, due to the inaction and indifference of the international community. It is in the interests of the people we help that we maintain a wide pool of support from within the Christian community and from other sympathetic sources.

A further ACN role is to support and encourage UK Christians in their faith and by providing inspirational examples from the suffering Church, prayer material and relevant faith-supporting trading products, we offer a service to UK Catholics and Christians.

  1. What personal information do we collect?

Personal information we collect about you may include:

Personal details e.g. name, postal address, phone numbers and email addresses, and in certain cases date of birth, NI number.

We collect this information when you contact us or donate by post, telephone or on our website.

 

We do collect Bank details – name, sort code and account number. When you set up a regular gift e.g. Direct debit or standing order with us.
The communications you exchange with us When you email, write a letter or call us
We collect information indirectly through third parties such as JustGiving where you have agreed to support ACN and have given your consent.

  1. How do we collect personal information?

We collect personal information about you when you interact with us. Most ACN UK benefactors are recruited via face-to-face via Appeals, Talks and Events. Many are already familiar with our work due to the involvement of their own parishes and/or through ACN UK material carried in the Catholic and Christian media. Indeed, many ACN benefactors consider themselves ‘members’ who receive faith-based benefits from their relationship with us. These include specialist news, information and prayer material, not readily available in the secular press.

For new benefactors met through face to face contact as well as online benefactors we obtain consent by a declaration form.

  1. How and why do we use personal information?

We use the personal information collected from benefactors for the following purposes:

  • to enable your donation(s) to reach your chosen charity/charities

We offer options about how and where benefactor donations are used. We ensure that donations are allocated appropriately to our various funds and geographical project areas

  • to manage your donations requests, or calls to action

When you interact with us, we use your information to perform our services in relation to deal with your donation, to deal with your queries and requests and to process responses to our campaigns or advocacy work.

to fundraise and promote ACN’s work in both financial and non-financial ways We know how fundamental our supporters and donors are to the work we do. In order to develop and foster your ongoing support, we want to keep in touch you through feedback and further opportunities and invitations to support our work in both financial and non-financial ways.

to communicate with you and manage our relationship with you

Occasionally we may need to contact you by mail, email and/or telephone for administrative or operational reasons.

to personalise and improve your experience when engaging with ACN

we strive to continually improve the information and services we offer to our supporters so that we can be good stewards of the resources we entrusted to us.

to inform you about our news and ways you may be able to help ACN

We may send you marketing communications, if you have indicated that you are happy to receive these for example, when you have donated or completed a campaign action and you haven’t opted-out of receiving of such communications.

to maintain and improve our own accounts, records and organisational processes, to fulfil our administrative purposes and protect our charitable interests. The purpose for which we will use your information include accounting, billing and audit, credit or other payment card verification, fraud screening, safety, security and legal purposes, statistical and marketing analysis, legacy administration, systems testing, maintenance and development.

We will use your information to enable your donation to be allocated to your chosen priority and charities so you may be contacted in the event of a specific query needed to resolve any issue with the processing of your donation.

  1. How do we store your Data?

Aid to Church in Need is committed to keeping your personal information safe and secure and we have security policies and technical measures in place to help protect your information. We will put in place procedures and technologies to maintain the security of all personal data from the point of collection to the point of for as long as we hold your data. Personal data will only be transferred to a third party service provider company if they are approved by us and agree to comply with these procedures and policies, or if they put in place adequate security measures.

All our employees who process data are obliged to comply with our strict information security procedures. Electronic data communication, comprising personal data is always encrypted so that it is not read by anyone except the person responsible for the data.

  • WHERE YOUR DATA IS HELD

ACN (UK) data is stored on ACN servers based in Belgium and managed by ACN International’s IID Department who oversee the Content Management Systems of ACN’s offices around the world to maintain data and results reporting integrity. They have an additional responsibility for overseeing Data Protection standards across all offices. Your personal data is held on secure servers operated by ACN UK and the ACN international Help Desk. Paper files are stored and kept in a secured filing system and locked all the time except in time of in need for a reference by a member of a staff. For the purpose of guaranteeing confidentiality we have taken permanent measures as follows:

  • electronic access control system,
  • security doors and windows,
  • alarm system,
  • video surveillance,
  • special protection of the server room,
  • individual log-ins and password procedures,
  • additional log-ins for certain applications,
  • automatic locking for the clients (Timeout),
  • managing permissions,
  • documentation of permissions, and
  • many other measures.
    • DATA CLEANING

Active data sets used for our mailing programme of ten mailings a year are cleaned regularly using industry standard programmes.

In early 2018, ACN’s full data set was cleaned by One Post with the aim of providing two definitive Usable and Unusable data files.

  • DATA DESTRUCTION

Due to ACN (UK)’s policy of not purchasing, swopping or sharing data and given the limited data Aid to the Church in Need therefore has access to, data deemed ‘unusable’ will be flagged and made unusable for the purposes of mailing or future contact but available for analysis and as a historical record. ACN’s Reactivation experience shows that due the organic nature of our data capture and because lapsed benefactors may contribute anonymously at Parish Appeals or events and read about us in the Catholic press, our reactivation response rates are unusually high against charity sector benchmarks. For this reason and because Catholics and Christians have a life-long affiliation to their faith and related issues, our lapsed and deeply lapsed data continues to hold value for us. Therefore, ACN’s policy is to hold data longer than other charities might.

Following the 2018 data clean, benefactor records with a last gift date of 25 years plus will be destroyed and annually thereafter. Within the usable data set, active and reactivation data will be held for ACN’s mailing programme. With the exception of Always Mail records, data will be segmented by date of last gift. Regarding Gone Away notifications. Upon the second notification, these records will be flagged as unusable.

  1. Lawful Basis for processing your personal information

ACN will process personal data in line with the following principles:

  • where it is necessary for us to fulfil a contract with you
  • with your consent
  • when it is in our legitimate interest

Under Article 6 of the General Data Protection Regulations (GDPR) our lawful basis for processing and holding personal information is ‘legitimate interest’ as it is necessary for ACN to use this information in order to provide you with our services.

According to Art. 9 Sec. 1 GDPR, the processing of sensitive data is generally prohibited. Special categories of personal data (also “sensitive data“) are personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

As a Pontifical Foundation, ACN falls under Article 9 section 2 paragraph (D), which the processing is carried out in the course of its legitimate activities with appropriate safeguards by a religious aim and on conditions that the processing relates solely to the persons who have regular contact with ACN UK in connection with its purpose and that the personal data are not disclosed outside ACN UK without the consent of the data subjects.

When donors fill in their personal data in a donation form presented by an ACN area secretary or appealer, they may hereby also reveal their religious belief. Donating to ACN means donating to a Pontifical Foundation of the Catholic Church, supporting the Catholic faithful and other Christians where they are persecuted, oppressed or in pastoral need“.

  • ACN (UK): LEGITIMATE INTEREST

As a religious organisation which recruits new benefactors in a very personal way, ACN (UK) has chosen to adopt Legitimate Interest as our approach to GDPR legislation. However, the rights of the benefactor are paramount and ACN (UK) sets out in this document, policies and procedures that allow benefactors to change their contact preferences or stop hearing from us completely.

Charities are required to undertake a ‘balancing’ assessment to ensure that the needs of the charity do not override the rights of the benefactor. Copies of the ACN (UK)’s marketing balancing assessment may be obtained from the ACN UK’s national office. Most ACN (UK) benefactors are recruited via face-to-face via Appeals, Talks and Events. Many are already familiar with our work due to the involvement of their own parishes and/or through ACN (UK) material carried in the Catholic and Christian media. Indeed, many ACN benefactors consider themselves ‘members’ who receive faith-based benefits from their relationship with us. As a religious charity we believe ourselves to have a legitimate interest in informing and up-dating Catholics and Christians on the situation facing our faith today. In turn, our benefactors, who have a life-long commitment to their faith, are legitimately interested in the niche information and faith-enhancing material we provide and which they are unlikely to get elsewhere. Benefactors would therefore reasonably expect that we would process their data to provide them with such information if they have previously established a relationship with the charity.  Never-the-less with a view to protecting our benefactors’ interests and balancing these with our legitimate interest we will always aim to consider safeguards to reduce the impact on their interests and their privacy.

  • ACN UK’s REGISTRATION AS A DATA CONTROLLER

Aid to Church in Need is registered as a Data Controller with the Information Commissioner’s Office (ICO). Its registration number is: Z7989628

ACN (UK)’s Data Manager will oversee all aspects of data segmentation, retrieval, analysis and business insight and all software systems and processes associated with the processing of data by Aid to the Church in Need and third-party suppliers to fulfil business objectives including the administration of donations and product purchases.

The Data Manager will also fulfil the role of Data Protection Officer and be responsible for ensuring that Aid to the Church in Need UK complies with GDPR (General Data Protection Regulation) and all legislation covering Direct Marketing and Electronic Communications.

  • FAIR PROCESSING NOTICE

Our Fair Processing Notice covers the kind of information we use, what we use your Personal Data for, how we process and protect your information. Your personal data is information that you provide to us, which we record and process to offer you the information or service you require. Your personal data can include your name, postal address, email address, phone number, credit/debit card details and whether we can claim Gift Aid.

We collect your personal data when you contact us or register to receive information, make a donation, purchase goods or services, enquire about events or in any other way supply us with your personal information.

It is important that the personal data we hold about you is accurate, so please contact us to advise us of any changes. We will only use your personal data for the specific purpose stated at the time we collected it. Access to your information is limited to staff members and authorised third party suppliers who require it to carry out their work.

  • FUNDRAISING REGULATOR

Aid to the Church in Need registered with the Fundraising Regulator. This means that we are committed to the highest standards in fundraising, striving to work always in a way that is effective, open and honest, and dedicated to raising funds in the most cost-effective manner.

The Fundraising Regulator is an independent body which sets and maintains the standards for charitable fundraising. The board’s primary function is to deal with complaints about fundraising activity from members of the public, allowing people to give to charitable organisations with confidence. By joining the Fundraising Regulator we have agreed to adhere to the Code of Fundraising Practice and the Fundraising Promise

  • GDPR PROFESSIONAL ADVICE

Aid to the Church in Need subscribes to the Fundraising Regulator. We abide by (their guidelines) and act on benefactor address removals notified to us via their Fundraising Preference Service. With respect to GDPR compliance, Aid to the Church in Need is adopting Legitimate Interest for Direct Marketing. Professional Advice has been sought about this and data professionals have concurred with our approach:

Neil Finlayson, Kingston Smith, Chartered Accountants and Registered Auditors.   Nick Mason, Uplifting Data, Chair of Institute of Fundraising Technology Insight Group.

Aid to the Church in Need International has contracted KINAST (Attorneys at Law) Germany to oversee GDPR on behalf of all ACN offices where this European legislation applies. One of their representatives will advise on ACN UK’s final documentation.

  1. Do we provide information to other parties?

We will not share or sell your personal information to other charities or organisations for marketing purposes. We share your information with authorised third-party suppliers for the purposes of carrying out our work, for example, dispatching goods or information by mail. We may on occasion be required by law to pass on your personal data. For example, we would have to pass on information for a Gift Aid audit by Her Majesty’s Revenue and Customs. If we find it necessary to transfer, process or store personal data outside the European Economic Area (EEA), we will put in place suitable safeguards, including using the European Commission approved standard contractual clauses in data transfer contracts.

ACN UK works with third-party suppliers with who we have signed service level agreements and specific signed data policy agreements.

  1. Your privacy

Everyone has rights with regard to the way in which their personal data is handled. During our activities, we will collect, store and process personal data about our benefactors, suppliers and other third parties, and we recognise that the correct and lawful treatment of this data will maintain confidence in the organisation and will provide for successful business operations.

Your personal data, which may be held on paper or on a computer or other media, is subject to certain legal safeguards specified in the Data Protection Act and equivalent EU regulations.

This policy and any other documents referred to in it, sets out the basis on which we will process any personal data we collect from you or that is provided to us by yourself or other sources. This policy sets out rules on data protection and the legal conditions that must be satisfied when we obtain, handle, process, transfer and store personal data.

  1. Your choices/ rights

Under the General Data Protection Regulation, you have the right to request a copy of the personal data we hold about you and to have any inaccuracies corrected. We support your rights in relation to your personal information under the General Data Protection Regulation, including the:

  • Right to restrict processing
  • Right to data portability
  • Right to object
  • Rights related to automated decision making including profiling

You have the right to request a copy of the information we hold about you free of charge. Before we are able to assist with your request, we need you to confirm your identity and what data you require.   1. Data Breach

In the event of any unauthorized access to personal data, need to be reported to the Data Manager at ACN UK immediately and from there to be reported to the within 72 hours to the ICO (Information Commissioner’s Office)

In the event of the loss of a computer or personal device, this is to be reported to the Data Manager at ACN (UK) immediately and from there to be reported within 72 hours to the ICO (Information Commissioner’s Office).

Data breaches with respect to the loss of envelopes will be reported to ACN (UK) in Sutton immediately and within 72 hours to the ICO (Information Commissioner’s Office).

 

  • DATA CONCERNS AND COMPLAINTS

If you have concerns about your data handling at Aid to the Church in Need UK, please contact us. We will acknowledge your concern and undertake to deal with them promptly, fairly and confidentially.

Requests to correct data inaccuracies are referred initially to our Data Input department for amendments. In due course, all data enquiries will be overseen by our Data Manager. If you feel your concerns have not been met, then Complaints are addressed to the Data Manager and referred to the Complaints Committee, whose decision will be final.

In the first instance, you should contact Aid to the Church in Need using our standard complaints procedure. If you remain unhappy with our use of your personal data, you have the right to complain to the Information Commissioner’s Office. We would encourage you to contact us in the first instance so we can attempt to resolve concerns you may have.

We use trusted commercial partners to process online transactions for single and regular donations and purchases made via this website. We have no access at any time to the card details which you submit online.

You have the right to restrict the processing of your personal data or to stop us processing it altogether. You also have the right to ask us to stop sending you information.
